09/19/1979 - City Council Special 00243 MINUTES OF A SPECIAL MEETING OF THE EAGAN CITY COUNCIL EAGAN, MINNESOTA SEPTEMBER 19, 1979 A special meeting of the Eagan City Council was held on Sep- tember 19, 1979, at 7:00 p.m. at the Eagan City Hall. Those present were: Councilmembers Egan, Smith, Wachter and Parranto. Absent was Mayor Murphy. Also present were City Administrator Hedges and Director of Finance VanOverbeke. 1980 PROPOSED BUDGET The fourth budget review session to consider the proposed 1980 budget was held. A detailed analysis of line item accounts and basic philosophy of all departmental budgets was reviewed and the City Administrator was directed to make the necessary revisions for the next budget review session. A majority consensus of the City Council was to make no change in manpower for Financial Admini- stration, Planning, General Government Buildings, Police and Pro- tective Inspection for 1980. City Councilmember Wachter expressed concern that additional Police personnel are needed and should be included in the 1980 budget. There was a manpower increase consi- dered for Public Works Administration, one clerical position; High- way Maintenance, one maintenance position and one-half receptionist; and in Park Maintenance to include one maintenance and one-half receptionist. There was no further discussion on the 1980 proposed budget and the City Administrator was directed to revise all the accounts including revenues and expenditures as directed. The next budget review session was set for September 25, 1979, at which time the mill levy for 1980 would be considered. ADMINISTRATIVE SECRETARY The City Administrator informed the Council that he had received a letter of resignation from Sharon Kline, administrative secretary, effective October 1, 1979, and that he recommended that Holly Duffy, the present receptionist at the City Hall, be promoted to that posi- tion. Parranto moved and Wachter seconded the motion to accept the resignation of Sharon Kline, to hire Holly Duffy as administra- tive secretary, effective October 1, 1979, and to direct the City Administrator to advertise to fill the position of receptionist. All members voted in favor. I-35E (CONSIDERATIONS OF MODIFICATIONS TO THE A-2 ALIGNMENT The City Council relocated the meeting from the City hall to the Conference Room in the Police Department Building to hold a discussion on the I-35E (Modification to the A-2 Alignment) matter. Several residents of the community, Mr. Mac Hyde, special legal counsel for the I-35E issue, Public Works Director Colbert and Con- sulting Engineer Bob Rosene all appeared and participated in an informal discussion regarding the need for response by the City of Eagan to the Minnesota Department of Transportation regarding which modification is acceptable to the A-2 alignment if the A-1 00244 City Council Minutes September 19, 1979 Page Two alignment is not selected as the corridor for the I-35E project in the City of Eagan. Mr. Don Christianson appeared and read a statement expressing objection to any consideration for a modifica- tion to the A-2 alignment. He stated that, with the District Court's recent decision to overrule the decision of the DNR Commissioner to construct the road around the lake, the City Council should only consider the A-1 alignment for the I-35E corridor. He further stated that construction of a collector road west of Fish Lake or moving the I-35E corridor to the East of Blackhawk lake would cause an environmental impact on Fish Lake. He further stated that he is planning to require an environmental impact statement for any alter- nate that is considered if the A-1 alignment is not selected by the Minnesota Department of Transportation for the I-35E corridor. Mr. John Klein, representing Urban Council on Mobility, appeared and stated that he is totally in support of the A-1 alignment for the I-35E corridor; however, Alternate A-4 is the best modification to the A-2 alternative. Mr. Klein doubted whether MnDOT could pro- ceed with the work on any alignment other than the A-1 alignment which, as a result of Judge Jerome Kluck's decision at the District Court level in Dakota County, is the alignment for the I-35E corridor in the City of Eagan. Mr. Dale Turnham appeared and stated that he is also in favor of the A-1 alignment, however would favor the A-4 modification to the A-2 alignment if the Interstate is to be constructed to the East of Blackhawk Lake. Mr. Mac Hyde, who has represented the City of Eagan as Special Legal Counsel on the I- 35E issue, made a number of comments regarding a time schedule, appeal process and other questions as asked by the audience and City Council. The City Administrator stated that the City Council has been asked to respond by resolution to a public hearing that was held by the Minnesota Department of Transportation on August 30, 1979 regarding which modification to the A-2 alignment would be preferable if the A-1 corridor is not selected. He further stated that the matter will appear on the October 2, 1979 agenda for consi- deration. Comments were made by members of the City Council that any action addressing the modifications to the A-2 alignment are specifically in response to the Public Hearing held by MnDOT on August 30.
