MINUTES OF A SPECIAL MEETING OF THE EAGAN CITY COUNCIL
EAGAN, MINNESOTA
September 28, 1978
A special meeting of the Eagan City Council was held on September
28, 1978 at 7:00 p.m. at the City Hall pursuant notice. Those present
were Mayor Murphy and Council Members Smith, Egan, and Parranto. Absent
was Council Member Wachter. Also present were Keith Gordon, Consulting
Engineer representing the firm of Bonestroo, Rosene, Anderlik & Assoc.
and City Administrator Hedges.
ASSESSMENT HEARINGS. At 7:00 p.m. the Mayor convened the following
hearings concerning special assessments in the City of Eagan, notices
of which had been published in the Dakota County Tribune and copies sent
to affected property owners. The City Administrator explained each of
the assessment projects and an opportunity was given to affected property
owners present to ask questions and express opinions concerning the
assessments.
1. Improvement Project #198A and 210A Cedar Ridge Addition
sewer, water, storm sewer and streets. There were no objections.
Upon motion by Parranto, seconded Smith, all members voting in favor, it
was RESOLVED that said assessment roll be adopted and ordered certified
to the Dakota County Auditor.
2. Improvement Project #216 (Change Order to Project 198A)
Mallard Park 1st Addition sewer, water, and storm sewer. There were no
objections. Upon motion by Smith, seconded by Egan, all members voting
in favor, it was RESOLVED that said assessment roll be approved and
ordered certified to the Dakota County Auditor.

3. Improvement Project #186 (Combined with 227A) Storm sewer
for sections 18, 19, 30, and 31. There were objections from certain
property owners present concerning the amount of the assessments being
levied and a request for special consideration to provide relief to their
assessments. Mr. Perwin appeared objecting to his storm sewer assessment
that was levied against parcel 10 01900 020 25. His objection was
relative to the amount of the assessment that was levied against property
that was not developable abutting a flood plain district. Mr. Perwin did
not object to the project or the assessment rates, however, felt that for
that property that cannot be developed, the assessment should be adjusted
accordingly for this portion of the parcel. City Council Member Egan
suggested that Mr. Perwin speak to the Assessment Review Committee regarding
his objection as soon as an appeal is made in writing by Mr. Perwin. Mr.
Steven Beatty appeared representing Metram Properties Co. which is the owner
of Parcel 10 01900 011 54 7 and objected to the storm sewer special assessment
on the grounds that the amount of said proposed assessment exceeds specific
benefit to the property of record. Mr. Jim Connor appeared representing
Northern Natural Gas Company and objected to the special assessments that
are proposed against their parcel described as parcel 10 01900 031 52. Mr.
Connor specifically objected to a special assessment for sewer, water, storm
sewer and street improvements. It was explained that the Northern Natural
Gas parcel is only assessed for storm sewer improvements. The City Administrator
reported that letters of objection were received from the Minnesota
Department of Transportation, Northern Natural Gas Company, and Metram
Properties Company. There being no further objections on the proposed
assessments a motion was made by Egan, seconded Smith, all members voting in

favor, it was RESOLVED that said assessment roll be approved and ordered
certified to the Dakota County Auditor.
4. Improvement Project #210A. There were no objections. Upon motion
by Smith, seconded Egan, all members voting in favor, it was RESOLVED that
the roll be adopted and ordered certified.
5. Improvement Project #204 (Combined with #210A) - - Blackhawk Hills
2nd Addition street improvements. There were no objections. Upon motion
by Parranto, seconded Smith, all members voting in favor, it was RESOLVED
that the assessment roll for said project be approved and ordered certified
to the Dakota County Auditor.
6. Improvement Project #210A Water area improvement for Section 27.
There were no objections. Upon motion by Smith, seconded Parranto, all
members voting in favor, it was RESOLVED that the assessment roll for said
project be approved and ordered certified to the Dakota County Auditor.
7. Improvement Project #196 West Publishing Company 1st Addition
sewer and water. There were no objections. Upon motion by Smith, seconded
Egan, all members voting in favor, it was RESOLVED that the assessment roll
for said project be approved and ordered certified to the Dakota County Auditor.
8. Improvement Project #195 Wescott Road street improvements
between County Road 63 and Elrene Road. There were no objections. Upon
motion by Eagan, seconded Parranto, all members voting in favor, it was
RESOLVED that the assessment roll for said project be adopted and ordered
certified to the Dakota County Auditor.
9. Improvement Project #214 Sibley Terminal Industrial Park storm
sewer. There were some questions raised by some property owners in the
Heritage Lane - LeTendre Addition area concerning the assessments for the
Sibley Terminal Industrial Park area. There were no objections expressed by

any of the property owners. Upon motion by Smith, seconded Parranto, all
members voting in favor, it was RESOLVED.that the assessment roll for said
project be adopted and ordered certified to the Dakota County Auditor.
Smith moved and Egan seconded the motion with all members voting aye
to adjourn at 8:45 p.m.
