09/20/1966 - City Council Regular MINUTES OF A REGULIR MEETING OF THE BOARD OF SUPERVISORS OF EAGAN TOmSHIP, DAKOtA COUNTY t MINNESOTA September 20, 1966 A regular meeting of the Board of Supervisors of Eagan Township was held on. September 20, 1966 at 7;30 o'clock P. M. at the town hall at which all members were present. Chairman Rahn presided, and announced that the meeting had been called to order at 7:30 in order to open bids in connection with a sanitary sewer tmprovement consisting of sewage treatment facilities, trunk sewers, aM lateral sewers ordered by the BOard of S9pervisors on April 5, 1966, and part of the expenses incurred and to be incurred for a water improvement consisting of an elevated storage tank and trunk water mains ordered by the Board of Supervisors on July 27, 1966, all as more fully set forth in separate minutes hereto attached and made a part hereof. Neat the minutes of the previous meeting of the Board of Supervisors were unanimously approved as read. Mr. Simon N. AnzelllO appeared on bebBlf of his application for a variance under Ordinance 16 in order to place an addition to his structure located at 3500 Dodd Road and a180 requested the issuance of a building permit. It was noted that the Advisory Planning Committee recommended approval subject to certain conditions. Upon motion duly made by Supervisor Schwanz and seconded by Chairman Rahn, it was RESOLVED to approve the application for variance subject to the submission by applicant to the town engineer of an appropriate site plan and the review and approval by the town engineer of the plans and specifications. Robert Daly appeared on behalf of the application of Burnsville Ievestment Co. for a special use permit and building permit under Ordinances No. 3 and No. 6 for the construction of a Skelly Oil Service Station in the Northeast 1/4 of Section 3-27-23. It was noted that the Board had previously conSidered this matter on January 19, 1965 but that the Advisory Planning - 1 . Committee at its meeting next preceeding this meeting r.ec~ended 4enial. Mr. Daly explained that he was unable to consumate his deal without being able to obtain a building permit and was therefore applying for a l permit at this time. Upon motion duly made by Chairman Rahn and seconded by Supervisor Schwanz, it was RESOLVED that the application be, and the same hereby is, duly approved subject to and upon the follOWing conditions: That applicant and the property owner shall not commence any actual construction upon said premises until all contracts are awarded by the State of Minnesota for the construction of Interstate Highway #494; t~at applicant and owner shall provide Eagan Township prior to any such constructior. appropriate easements for water, sanitary sewer, storm sewer, aDd for highway right of way along County Road 131 of not less than 7S' from the center line of said road, all at applicants' expense. The street plan layout for the Eagandale Addition by the Rauenborst Corporation was submitted for approval. It was noted that the Advisory Planning CQIJlD1ittee recODlllended approval subject to certain conditions. Upon motion duly made by Supervisor Klein, seconded by Chairman Rahn, it was RESOLVED that the street plan layout be, and the same hereby is, approved as to the general street layout with the exception of the South terminal of the North-South street on the East Boundary of Country Home Heights, all subject to the town enai.Deers approval of street grades and ordinance requlreme~,. Mr. John G. Schneider appeared on behalf of his application for a building peunit to construct a beauty shop on Cedar Avenue South, located on the S 75' of the N 27S' of the E 225' of the NW 1/4 of Section 30-29-23. Upon moticn by Chairman Raba t seconded by Supervisor Klein, it was RESOLVED that said building permit application be, and it hereby is, approved subject to approval of plans and specifications by the town engineer. - 2 - Mr. Veruon Colon appeared with his attorney, Roger Miller, on behalf of the former's application for the re-zoning of the N 250' of the B 200' of the NE 1/4 of the HE 1/4 of Section 16-27-23 from A, Agricultural to C-l, Light Commercial. It was noted that the application had been amended to read the N 460' of the E 300'. It was further noted that the Advisory Planning Committee recommended approval. Upon motion duly made by Chairman Rahn, seconded by Supervisor Schwanz, it was RESOLVED that a public hearing be held upon the application on October 18, 1966 at 7:30 P. M. at the town hall and the clerk and town attorney be directed to prepare the appropriate notices thereof and publish and mail same according to law. Mr. Thomas Mohr did not appear with reference to the Dodd View Addition. Proposed Amendment to Ordinance #10 regarding topographie 11', s was tabled by the Board on the recommendation of the town attorney. Mr. Jean Parranto appeared with a preliminary plat for proposed Cedar Industrial Park to be situated in Section 17-27-23. The matter was considered. Upon motion duly made by Chairman Rahn and seconded by Supervisor Klein, the preltminary plat was refered to the town engineer for further study and report back to the Board. The matter of the Yankee Doodle Road agreement with the Dakota County Board of Commissioners was discussed. The town sttorneypointed out that there was a possibility that the County could return this road to the township on its own motion in spite of the agreement heretofore reached and in spite of the fact that the town might prevail in any law suit brought against the County. Upon motion duly made by Supervisor Klein and seconded by Supervisor Schwanz, it was RESOLVED that the town attorney take legal action to enforce the te~ of the agreement as to the take-over by the County of Yankee Doodle Road. - 3 - Upon motion duly made and seconded it was RESOLVED that the assessment hearing on Cedar Grove #5 sewer improvements and on Rahn Road street improvements be set for October 14, 1966 at 7:00 o'clock P. M. and 8:00 o'clock P. M. respectively and the clerk directed to publish notices thereof according to law. Upon motion, the bills were ordered paid as approved. Upon motion, the meeting adjourned.
