05/23/1967 - City Council Special MINUTES OF A SPECIAL MEETING OF THE BOARD OF SUPERVISORS OF EAGAN toWNSHIP, DAKOTA COUN'lY, MINNESOTA May 2'3, 1967 A spectal meeting of the Board of Supervisors, Eagan Township, was held on May 23, 1967, at 7:30 o'clock P. M. at the town hall at which all members were present. Chairman Klein announced the public hearing concerning the application of Vernon Colon to rezone the West 240 feet of the South 225 feet of the SW 1/4 of the SW 1/4 of Section 10, T 21N, R 23W from A, Agricultural to E-l, Light Comm.~el~l. It was noted that there were no objecting.property owners present, and further that the affidavit had been published according to law. In addition it appeared that there were no property owners within 900 feet of the property proposed for rezoning other than the grantor to the applicant. The Advisory Planning Committee had recommended approval. Upon motion by Chai~n Klein, seconded by Supervisor Schwanz, it \-1a8 RESOLVED that said application for rezoning be, and it hereby is, approved. At 8:00 o'clock P. M. the Chairman announced that the public hearing concerning proposed sewer and water improvements umer Public Improvement 1!l2 covering the MCKee addition had commenced. The Town Engineer presented his prel~inary report covering said public improvement 112. The town engineer made a presentation concerning cost estimates and a large group of residents were present with questions about the proposed tmprove~nt. At approximately 9:30 o'clock P. Me the Chai~n asked for a show of hands as to thOse in favor of the improvement and the result was approximately 3 to 1 in favor of the installation of the improvements. The Board then announced it would take the matter undel' advisement until the next regular meeting. the Clerk stated that she had received numerous bills from the Meadota Heights Fire Department covering fires along the Mib1aukee Road Railroad over - 1 - r""/~ the past several months. Upon motion by Chairman Klein, seconded by Supervisor Rahn it was RESOLVED that the town attorney be instructed to write a letter to Mr. W. K. Peterson, Division Superintendent of the Milwaukee Road, Austin, Minnesota, requesting reimbursement at the rate of $115.00 per hour for all fires that have taken place along the railroad this spring and which appear to have been caused by sparks from the dlesil engines. A letter WaS received from Doun Smith, 4123 Diamond Drive, relative to drainage problems on his property. Upon motion by Chairman ~ seconded by Supervisor Schwanz it was RESOLVED that the town engineer be directed to inspect the drainage problems on the property and report back to the Board. Upon motion duly made by Supervisor Schwanz, seconded by Chairman Klein, it was RESOLVED that the bid of L. J. McNulty, Inc. for Cedar Grove No.5, Improvement Project No. 13, sewer and weter services be, and it h~rehy is, accepted at the sum of $41,978.50. Upon motion the meeting adjourred. Dated: May 25, 1967. dLz;/ (..( / Ba~,-, Clerk - 2 - MINUTES Public Hearing, May 23, 1967 Pursuant to due call and notice thereof, a Public Hearing was held at the Town Hall on the 23 day of May, 1967 at 8:00 o'clock P.M. at which all members were present, together with Engineer Robert Rosene. Chairman Klein presided. Chairman Klein stated that the purpose of the Public Hearing was to consider the proposed extension of watermains and laterals and sanitary sewer trunk lines and laterals covering all of the McKee additions as per published and posted notices. He then turned the meeting over to the Engineer, Mr. Rosene. Mr. Rosene explained that the overall sewer and water system will go down Kenneth St. and the East border of McKee. The total cost would be $613,880.00. 20% of the cost of the street improvement is carried by the trunk assessment and as part of the large project would be less costly. According to cost figures in the preliminary report it is estimated $1,261.50 would he assessed per 70' residential lot for Trunks, Sewer & Water laterals and stubs, plus a $200 connection charge for Sewer and a $200 connection charge for w~ter. If this project were delayed for two or three years, the costs would probably be $6.90 for sewer laterals and $4.60 water laterals, $6.10 street improvement and $173 for service stubs. He then stated he would answer any questions. Mr. Rainford; 1065 Beatrice: What is hardness of the water we would be getting? Answer: 17 grains and would be from the Jordan Strata. Bert Spohn, 1050 Beatrice: What would be the monthly charge? Answer: Approximately $2.50 - $3100 for sewer and a minimum of $2.00 for water. D. Rainford: How can they be lower than surrounding area? Answer: Burnsville is $7.50 quarter for sewer and $2.00 a month for water. Apple Valley is approximately the same. Darcy Cole, 2985 So. Lexington: Which side and how far South will this go? Answer: East of Lexington with water on the West Side. If the people on the West side of Lexington desire it tt could go to Co. Rd. 26, otherwise would cost considerable more at a later date. - 2 - Mrs. Wildenauer, 1025 Kenneth: Will you be putting in water and sewer at the same time and how long will it take? Ans: Yes, but one trench at a time and they will move through real rapidly. Mrs. Wildenauer: How long will it be before we can drive on these streets? Ans: We would require the contractor to have the streets passable and it will take less than a month. In fall a gravel base will be put down and Bituminous surfacing would be put in in the Spring. Mr. Wildenauer: How will Industrial property be assessed and why aren't they assessed as h03eowners? Ans: They are assessed on a per acreage basis and charged 10a~ of cost of services. It wouldn't be feasible to charge as a homeowner. Mr. Anderson: Will Kenneth be assessed whether the other area is or not? Ans: I do not know what the policy will be. The Board could go back and charge interest etc. if and when they decide to hook up if not assessed at this time. Mr. Ronald Harris, Riverview Dev. Corp, Sp. Paul: Has purchased acreage South of Arrow Tank and would like to know how soon they can have service. fmswer: We can serve this property with this project. Mr. Weiss; 1033 Beatrice: How would service go into the lots? Ans: Most will be getting fro@ the front but a corner lot could be different. Herb Korf; 2868 Sol Lexington: Do we get charged an assessment for Lexington Ave & McKee streets also? Ans: Will not be assessed for street improvement in McKee area and laterals will be going down the boulevards on Lexington as they are extra wide and it would be too expenxive to tear up Lexington. Earl Blackley, 1038 Beatrice: Will thece be fire hydrants? Ans: Yes, and would result eventually in reduced fire insurance rates, approx. 30% reduction. Mr. Blackley: Will we be assessed again when the temp. treatment plant is replaced? Ans: No, there will be no additional assessment. That will be taken care of be connection charges. Mrs. wildenauer: Does anyone expect a tax increase because of this project? Ans: Very unlikely, except that the lots may get a slightly higher evaluation. D. Rainford: Will this be assessed at 6%? Ans: Yes over 20 years. Gerald Smith, 1065 ~eefe: How is the trunk assessment figured? Ans: Trunks are figured on an area basis for oversizing of lines and this is $100 per lot and $175 per net acre. Nr. Hattebarg, 1033 McKee: Would it be possible to put water in alone? Ans: No, because of tearing up streets. These are 10" apart but streets are torn up crosswise in order to put in services and would therefore be too costly. - 3 - Steve Westbrook, 1052 McKee: What is requirement re sewer and water in same trench? Ans: They need more costly pipe. Gary Summerland, 1057 Beatrice: If we sell in 5 years how is assessment handled? Ans: FHA requires all assessments be paid but a conventional loan does not figure these in. G. Summerland: What would it cost from the stub to the house? Ans: Costs vary so that you'd have to get this from your p~umber. Mr. Blackley: Will we have a water tower in this area? Ans: No. However we will eventually have 5 in Eagan but presently will need only one. There being no further question, Supervisor Rahn aequested the Chairman to ask for a show of hands and approximately three to one were in favor of going ahead with this project at the present time.
